Whether you are able to receive additional benefits beyond the end of your workers’ compensation depends on how your case originally settled. If it closed with an order approving settlement or a percentage of disability, then you can reopen your case within two years of receiving a final benefit. In contrast, you will not be able to reopen your case if it was resolved in court through a dismissal with prejudice and a one-time payment.
If you have received money from your award or have been sent by the insurance company to the doctor within the past 2 years, then these would constitute a final award, resetting the two-year statute of limitations.
